Terms of Use of the Nohô Platform
Important: These Terms of Use are governed by French law. References to legal provisions refer to the French legal framework (Consumer Code, Civil Code, Sports Code, General Tax Code, GDPR as applied in France, etc.).
The GUESTRAVELER matchmaking service (hereinafter the “SERVICE”) is provided on the NOHÔ platform (hereinafter “NOHÔ” or the “PLATFORM”) by GUESTRAVELER, a simplified single-shareholder joint-stock company (SASU) with share capital of 13,000 euros, registered under number 821 903 374 with the Caen Trade and Companies Register, whose registered office is located at 73 rue Marie Curie, 14200 Hérouville-Saint-Clair, France, and whose intra-community VAT number is: FR 10 821 903 374.

Preliminary Article: Definitions
When used in capital letters, the following terms, whether in the singular or plural, have the following meanings:
LISTING: a proposal for a PASSION SHARING EXPERIENCE issued by a Host and its characteristics (location, date, content, particularities).
LOGIN CREDENTIALS: a MEMBER’s identifiers and passwords allowing access to their ACCOUNT, which the MEMBER agrees to keep confidential.
REVIEWS: comments published by a MEMBER about their PASSION SHARING EXPERIENCE, published under the responsibility of the person who submits them. GUESTRAVELER may retroactively delete a REVIEW that does not comply with applicable legislation.
ACCOUNT: the SERVICE interface, hosted on the PLATFORM, centralizing all DATA provided by a MEMBER.
HOST PAYOUT: the portion of the BOOKING FEE paid to STRIPE by a NOMAD, transferred to the HOST by STRIPE. Its amount is equal to the BOOKING FEE less the PLATFORM FEE, i.e. approximately 85.72% of the BOOKING FEE.
DATA: personal data of a USER and/or a MEMBER within the meaning of Article 4 of the GDPR. For MEMBERS: first name, last name, postal and email addresses, photograph, date of birth, phone number, and other information entrusted to the PLATFORM (including bank details for HOSTS).
PLATFORM FEE: the portion of the BOOKING FEE transferred to GUESTRAVELER by STRIPE in consideration for making the PLATFORM and SERVICE available. Its amount corresponds to 14.28% of the BOOKING FEE, rounded to the nearest cent.
HOST: a MEMBER using the SERVICE, acting exclusively in their own personal name and on a non-professional basis, offering a PASSION SHARING EXPERIENCE to one or more NOMAD(S). Under no circumstances may a HOST register or act on behalf of a legal entity.
MEMBER: any USER who is a natural person aged 18 years or older, acting for non-professional purposes within the meaning of the preliminary article of the French Consumer Code, who registers on the PLATFORM to benefit from the SERVICE.
NOMAD: a MEMBER using the SERVICE not acting in the course of any commercial activity and wishing to subscribe to a PASSION SHARING EXPERIENCE provided by a HOST.
PASSION SHARING EXPERIENCE: a service provided by a HOST whose purpose is to share their passion, experience or one of their personal, professional or associative activities (non-exhaustive list).
BOOKING FEE: the price of the PASSION SHARING EXPERIENCE (taxes and fees included), freely set by the HOST within the limits of Article 6, paid by the NOMAD to STRIPE. Payable only once per booking, regardless of the number of participants, up to six (6) persons.
PLATFORM: accessible via the APP (Apple Store and Google Play) and the WEBSITE at www.noho.world. Also referred to as NOHÔ.
UNIVERSE: each category of PASSION SHARING EXPERIENCE offered on the PLATFORM: Sport, Art, Nature, Craft, Tourism.
CATEGORIES: categories in which LISTINGS may be classified: artistic, craft, nature, sport, tourism. This list may evolve at GUESTRAVELER’s discretion.
SERVICE: the matchmaking service accessible to MEMBERS registered on the PLATFORM.
REPORT: any notification of unlawful content or behavior, under the procedures of Article 18.
STRIPE: the secure online payment platform to which NOMADS pay their BOOKING FEE, allocated between the HOST and GUESTRAVELER without intervention by GUESTRAVELER.
USER: any natural person who accesses and browses the PLATFORM.
Article 1: Scope of the Terms of Use
These Terms of Use govern the relationships between GUESTRAVELER and USERS/MEMBERS, as well as between NOMADS and HOSTS. Use of the PLATFORM and/or SERVICE is subject to full and complete acceptance of the Terms of Use.
GUESTRAVELER may modify the Terms of Use at any time and at its sole discretion, in particular to adapt to its technical environment and comply with regulatory developments. USERS will be informed in advance (publication on the PLATFORM and/or email), with mention of the update date.
Continued use after publication of modified Terms of Use constitutes full acceptance. USERS who do not accept the modified Terms of Use will no longer be authorized to use the PLATFORM and SERVICE.
Article 2: General Presentation of the Service
NOHÔ connects, within the European Union, a HOST offering a PASSION SHARING EXPERIENCE with one or more NOMAD(S).
Sharing, respect for others and kindness are fundamental values of the SERVICE.
Each LISTING includes: location, date, passion sharing offered, accessibility for persons with reduced mobility, tips.
Booking process:
- The NOMAD selects a PASSION SHARING EXPERIENCE and, where applicable, a time slot.
- The request is sent to the HOST, who confirms or proposes an alternative time (except force majeure).
- Upon confirmation by SMS and/or email, the NOMAD pays the BOOKING FEE online.
- The agreement between the HOST and the NOMAD constitutes a civil contract to which GUESTRAVELER is not a party.
- Once paid, the NOMAD and HOST communicate via internal messaging (meeting location, exact time, number of persons, limited to 6 per PASSION SHARING EXPERIENCE).
- The HOST receives the HOST PAYOUT by bank transfer within forty-eight (48) hours from the end of the PASSION SHARING EXPERIENCE.
- The NOMAD is invited to leave a rating and review, accessible to USERS.
Article 3: Terms and Conditions of Access to the Platform
Any USER complying with these Terms of Use may access the PLATFORM.
USERS may share suggestions by email to contact@noho.world.
Article 4: Terms and Conditions of Access to the Service
4.1 Eligibility Conditions
The SERVICE is intended solely for persons at least 18 years old. Any access by a person under 18 is prohibited.
The SERVICE’s exclusive purpose is offering PASSION SHARING EXPERIENCES strictly compliant with the PLATFORM’s values, good morals and public order. Any proselytizing activity is strictly prohibited.
Strictly personal nature of registration. Registration is carried out exclusively on a personal basis, by a natural person. No legal entity may register, hold an ACCOUNT or publish a LISTING.
Sharing professional expertise. Permitted if the purpose is to introduce, explain or pass on. It may not consist in performing a service ordinarily marketed commercially by the HOST or a related legal entity.
4.2 Access Terms Applicable to All MEMBERS
Access requires prior creation of an ACCOUNT. Only one active ACCOUNT per MEMBER.
USERS warrant the accuracy of their DATA and are solely responsible for it.
LOGIN CREDENTIALS are strictly confidential and for personal use only. MEMBERS are responsible for acts committed via their ACCOUNT, even without their knowledge, and must immediately change their LOGIN CREDENTIALS if confidentiality is compromised.
Consequences of inaccurate data or inactivity:
- Erroneous, incomplete or outdated data → possible suspension or deletion (Article 9).
- ACCOUNT inactive for 1 year → possible suspension or deletion.
- ACCOUNT inactive for 3 years → automatic deletion if the MEMBER does not respond to GUESTRAVELER’s request.
4.3 Specific Terms Applicable to HOSTS
HOST data visible to USERS:
- First name
- Initial(s) of the last name
- Photograph
- Description of the PASSION SHARING EXPERIENCE
Information required for a LISTING: title, photo, address, description, tips, accessibility for children/reduced mobility, duration, maximum number of NOMADS, certified sports educator status if required, language(s) spoken.
Article 5: Terms and Conditions of a Passion Sharing Experience
5.1 Publication of a LISTING by a HOST
LISTINGS are published by HOSTS under their sole responsibility.
The HOST freely sets the BOOKING FEE within the limits of Article 6. Above 35 €, the LISTING is published only after prior approval by GUESTRAVELER (Article 6.2).
GUESTRAVELER refuses and removes any LISTING presenting the activity, products or services of a legal entity or professional activity.
5.2 Booking of a Passion Sharing Experience by a NOMAD
Booking Steps
The NOMAD selects a PASSION SHARING EXPERIENCE, a date and a time slot. The HOST confirms or refuses. The confirmed time slot is no longer offered for booking (exclusivity, Article 6.1).
The NOMAD accepts the Terms of Use, the Privacy Policy, and declares holding Civil Liability insurance, before paying. The BOOKING FEE is payable in full upon confirmation by the HOST.
No Right of Withdrawal
Pursuant to Article L221-28, 12° of the French Consumer Code, which excludes the right of withdrawal for leisure activities provided on a specific date or period, USERS expressly waive the right of withdrawal.
Cancellation and Refund

5.3 Participation of the NOMAD in a Passion Sharing Experience
The HOST is solely responsible for the execution of any confirmed booking. The HOST may ask the NOMAD to present identification.
5.4 REVIEWS: Feedback on Passion Sharing Experiences
REVIEWS must not be disparaging, discriminatory or defamatory. GUESTRAVELER does not control or verify their content.
Article 6: Financial Terms of a Passion Sharing Experience
6.1 Setting of the BOOKING FEE by the HOST

Any amount exceeding €35 is subject to prior approval by GUESTRAVELER (Article 6.2).
The BOOKING FEE is payable only once per booking, up to six (6) persons. Bookings are exclusive: no other NOMAD may be admitted to the same time slot, and the fee is payable in full regardless of the actual number of participants present.
The HOST may modify the fee at any time; this has no effect on already confirmed bookings. Amounts are tax-inclusive. No other amount may be required by the HOST.
6.2 Approval of Amounts Exceeding €35
Prior approval by GUESTRAVELER, within 48 working hours. Review based on: duration, equipment/materials provided, costs incurred, nature/specificity/rarity of the activity.
In case of refusal: decision reasoned and notified by email. The HOST has six (6) months to appeal at contact@noho.world.
6.3 Allocation of the BOOKING FEE

Allocation: 14.28% to GUESTRAVELER (PLATFORM FEE) / 85.72% to the HOST (HOST PAYOUT).
6.4 Payment Methods
Accepted methods: VISA, AMEX, MASTERCARD, via STRIPE, without intervention by GUESTRAVELER.
6.5 Annual Activity Limit of the HOST
The cumulative amount of BOOKING FEES for a single HOST may not exceed €5,000 per calendar year (approximately €4,286 in cumulative HOST PAYOUTS).
The HOST is informed by email at €4,000, then when the limit is reached.
Above the limit: review by a team member (non-automated decision), possible suspension of LISTINGS until January 1 of the following year. Decision reasoned and notified by email; appeal possible within 6 months at contact@noho.world. Already confirmed bookings remain in effect.
Scope of the limit. This limit is a contractual restriction specific to the PLATFORM. It does not constitute a tax or social security exemption threshold: sums received are taxable from the first euro (see Article 7).
Article 7: Information on Tax and Social Security Obligations
This article does not constitute tax or social security advice; the HOST remains solely responsible.
7.1 General Principle of Taxability
HOST PAYOUTS are in principle taxable from the first euro received, regardless of the total amount over the year and independent of any transmission obligation by the PLATFORM.
7.2 Transmission of Information to the Tax Administration (DAC7)
Pursuant to EU Directive 2021/514 “DAC7” (Articles 1649 ter A to 1649 ter E of the French General Tax Code), the PLATFORM transmits each year to the French tax administration the HOST’s identity, the number and gross amount of transactions, and the bank details.
Thresholds triggering automatic transmission:
- 30 or more transactions, or
- a gross cumulative amount exceeding €2,000.
These thresholds do not in any way condition the taxability of HOST PAYOUTS, which is governed by general tax rules (Article 7.1).
7.3 Applicable Tax Regime
Depending on activity volume: micro-BIC or BNC regime. HOSTS should consult www.impots.gouv.fr (collaborative economy page).
7.4 Social Security Obligations and Risk of Reclassification
Significant volume or regularity may lead URSSAF or the tax administration to reclassify the activity as professional. Penalties possible under Article L132-2 of the French Consumer Code for acting professionally while presenting as a non-professional.

7.5 No Advisory Role and Liability
GUESTRAVELER is neither a tax advisor nor a social security advisor and cannot be held responsible for the HOST’s declarations, taxes or contributions due, or any reclassification of their activity.
Article 8: Respective Obligations of Users, Members and GUESTRAVELER
8.1 Obligations Applicable to All USERS
Not disturb public order, comply with applicable laws, respect third-party rights and the Terms of Use.
8.2 Obligations Applicable to All MEMBERS
- Update their ACCOUNT.
- Be honest and truthful in the information provided.
- Ensure compliance with standards and third-party rights for any content distributed.
- Obtain rights/authorizations for works incorporated in LISTINGS.
- Use the PLATFORM in accordance with its purpose (no diversion for unlawful purposes).
- Apply behavioral standards: respect, courtesy, good faith, kindness, loyalty, safety.
- Respect privacy and confidentiality of exchanges.
- No defamatory, insulting or slanderous content.
- Not divert USERS to a competing service.
- Not harm automated systems (Articles 323-1 et seq. of the French Criminal Code).
- USE THE SERVICE EXCLUSIVELY FOR NON-PROFESSIONAL AND NON-COMMERCIAL PURPOSES.
8.3 Obligations Applicable Specifically to HOSTS
- Identify themselves with accurate and up-to-date information.
- Set the BOOKING FEE in compliance with Article 6, taking into account tax/social obligations (Article 7).
- Reserve the confirmed time slot solely for the booking NOMAD.
- Comply with the annual activity limit (Article 6.5), without circumventing it via multiple ACCOUNTS.
- Certify acting in their own personal name and on a non-professional basis (see 8.3.1).
- Hold valid civil liability insurance.
- Hold necessary permits for any equipment or specific equipment.
- Comply with safety rules.
- Provide a federation license or equivalent document for any regulated activity (sports educator, guide, instructor…) — the French Sports Code requires professional card, diploma, dedicated insurance, independent of the non-professional status declared on the PLATFORM.
- Update their LISTINGS.
8.3.1 Personal and Non-Professional Nature of the HOST’s Participation
Sharing professional expertise is permitted if aimed at introducing, explaining or passing on — it may not consist in performing a service ordinarily marketed commercially.
The following are prohibited, in particular:
- Registering or publishing on behalf of a legal entity.
- Mentioning corporate name, trademark, logo, professional contact details.
- Presenting or promoting a business’s products/services.
- Canvassing, commercial prospecting, quotations, orders, commercial contracts.
- Distributing business cards or commercial material.
Penalties possible under Article L132-2 of the French Consumer Code. Non-compliance constitutes a serious breach, liable to result in removal of the LISTING and suspension/termination of the ACCOUNT (Article 9).
8.4 Obligations Applicable Specifically to NOMADS
- Justify their identity if requested by the HOST.
- Be covered by their own civil liability insurance for any damage during a PASSION SHARING EXPERIENCE; the NOMAD assumes the associated risks.
8.5 GUESTRAVELER’s Obligations
Correct any error reported to contact@noho.world. Process GDPR requests in accordance with the Privacy Policy.
Article 9: Exclusion of a User or Member, Removal or Suspension of a Listing
GUESTRAVELER may suspend or terminate a USER’s access, at its sole discretion, at any time and without notice, for non-compliance with the Terms of Use.
In the event of unlawful conduct: immediate removal of LISTINGS/REVIEWS, cancellation of bookings, deletion or suspension of the ACCOUNT. Notification of grounds in accordance with Article 17 of EU Regulation 2022/2065 (DSA).
Appeal possible within six (6) months at contact@noho.world (Article 20 of EU Regulation 2022/2065).
In case of suspicion of a criminal offense, GUESTRAVELER may inform the criminal and judicial authorities.
Article 10: Intellectual Property Rights
10.1 GUESTRAVELER’s Intellectual Property Rights
GUESTRAVELER is the exclusive holder of all intellectual property rights relating to the PLATFORM and SERVICE.
USERS have only a limited, non-exclusive, non-transferable, non-assignable and free right of use (one copy of the APP on one device, personal and non-commercial use).
Prohibited: reproducing, modifying, creating derivative works, distributing, assigning, decompiling or disassembling the PLATFORM/SERVICE; using robots, scrapers, crawlers.
10.2 MEMBERS’ Intellectual Property Rights
Rights over content published by HOSTS and MEMBERS remain the property of their authors, published under their responsibility. By publishing them, they grant GUESTRAVELER the right to use them on the PLATFORM while online.
10.3 Limited Rights of USERS
Prohibited to use the name “GUESTRAVELER,” “NOHÔ,” the domain name, trademarks, logos, visuals, without express prior written authorization.
Article 11: Protection of Personal Data
Privacy Policy available separately (DATA processing, cookies). USERS who do not agree with this policy are invited to leave the WEBSITE and APP.
Article 12: Warranties of Users and Members
USERS warrant that they understand and will comply with the Terms of Use, and will not post disrespectful, insulting, defamatory, misleading, violent, hateful, racist, xenophobic, discriminatory, obscene, or harassing content.
They warrant not to use the PLATFORM for professional, commercial or profit-making purposes.
Important legal note: the statutory warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) does not apply to this relationship between non-professionals; remedies fall under general contract law and civil liability.
Article 13: Warranties of GUESTRAVELER
GUESTRAVELER uses reasonable means to ensure proper functioning, without warranting the full reliability of content posted by MEMBERS. Mandatory statutory warranties (consumer law) remain fully in force.
Article 14: Liability of Users and Members
Each USER/MEMBER is solely responsible for their own actions, negligence or omissions (Article 1240 of the French Civil Code: “Any human act which causes damage to another obliges the person by whose fault it occurred to make reparation for it”).
Article 15: Liability of GUESTRAVELER
15.1 Technical Liability
GUESTRAVELER, a mere technical intermediary, uses best efforts to provide 24/7 access, except in cases of force majeure or maintenance. Liability limitations do not apply to gross negligence, willful misconduct, bodily injury, or breaches of mandatory consumer rights.
15.2 Limited Liability as a Platform
GUESTRAVELER cannot control the identity of MEMBERS, LISTINGS, or the conduct of PASSION SHARING EXPERIENCES, and is not a guarantor of any MEMBER or LISTING.
In accordance with the EU DSA Regulation 2022/2065 and French law as amended by Law No. 2024-449, a REPORT mechanism is available via the dedicated icon or contact@noho.world, or by registered mail to the registered office.
15.3 No Liability for Use by USERS
GUESTRAVELER is not a party to any agreement made between MEMBERS. Any agreement between a HOST and a NOMAD binds only those two parties.
15.4 Links to Third-Party Sites
GUESTRAVELER has neither control nor editorial responsibility over linked third-party sites.
15.5 Nature and Extent of Liability
Subject to mandatory consumer law provisions and cases of bodily injury, gross negligence or willful misconduct, GUESTRAVELER’s liability is limited to direct, foreseeable damages actually suffered, excluding indirect damages (loss of profits, data, business interruption).
Article 16: Force Majeure
GUESTRAVELER cannot be held liable in the event of force majeure (Article 1218 of the French Civil Code), including any malfunction of telecommunications networks.
Article 17: Notices
Single point of contact: contact@noho.world, or registered mail with acknowledgment of receipt to the registered office (mentioning “SERVICE NOHÔ”).
Article 18: Reports
GUESTRAVELER is not required to verify the content of LISTINGS/REVIEWS but may carry out voluntary checks.
Any USER may report via the dedicated icon. Systematic acknowledgment of receipt and information on actions taken.
Manifestly unfounded, serious and repeated REPORTS may lead to suspension of report processing for their author and legal proceedings.
Article 19: Independence of the Parties
GUESTRAVELER, USERS and MEMBERS are legally independent entities.
Article 20: Non-Waiver
GUESTRAVELER’s failure to exercise a right does not constitute a waiver of enforcing it subsequently.
Article 21: Dispute Resolution
Governing law: French law (Article 17 of Law No. 2004-575 of June 21, 2004).
Consumers retain the right to bring proceedings before the courts of their State of domicile (EU Regulation 1215/2012 “Brussels I bis,” Articles 17 to 19).

In case of failure or no response within two (2) months:
- Mediation via the French Commission for Assessment and Control of Consumer Mediation (CECMC) or the European online dispute resolution platform (https://ec.europa.eu).
- For USERS established in France: French National Association of Mediators (ANM), 62 rue Tiquetonne, 75002 Paris, France, or www.anm-conso.com.
